CONSELHO TUTELAR E FAMÍLIA: ABORDAGENS, ESTRATÉGIAS E DESAFIOS – UM ESTUDO SOBRE OS CONSELHOS TUTELARES DE FORTALEZA (CE)

Resumo:
Este estudo tem como objetivo investigar a abordagem à família no contexto do Conselho Tutelar do município de Fortaleza (CE), assim como verificar a compreensão da família como sistema; observar a participação do Conselho Tutelar na abordagem às famílias; identificar aspectos essenciais da política de funcionamento dos Conselhos Tutelares; e averiguar as análises históricas sobre a família, infância e adolescência. Além da pesquisa bibliográfica e documental, foi realizada uma pesquisa de campo com abordagem qualitativa e entrevistas com diversos interlocutores: conselheiros tutelares, Conselho Municipal de Defesa dos Direitos da Criança e do Adolescente, Fundação da Criança e da Família Cidadã, Ministério Público do Estado do Ceará e Pastoral do Menor. Esta pesquisa foi construída em torno de uma introdução, 4 (quatro) capítulos e uma conclusão. A introdução trata de questões centrais do Conselho Tutelar e da família. No segundo capítulo, destacamos o movimento de ampliação de democracia representativa para a democracia de base. Os Conselhos Tutelares são concebidos como um dos espaços de mudança na direção de uma esfera pública democrática. O terceiro capítulo trata das definições da família ao longo das décadas e suas transformações, a participação do Conselho Tutelar na abordagem às famílias e a sua conexão com o direito à convivência familiar e comunitária de crianças e adolescentes. No quarto capítulo dissertamos sobre o fator regulamentador do Conselho Tutelar do Município de Fortaleza. O quinto capítulo aborda as discussões sobre o papel do conselheiro tutelar e sua compreensão da família no sistema; as funções atribuídas ao cargo e suas principais dificuldades; os aspectos essenciais para o funcionamento do Conselho Tutelar; a interação conselheiro-família-instituição e a política de atendimento. Por fim, tem-se as principais conclusões desta investigação. Palavras-Chave: Família. Conselho Tutelar. Direitos.
Abstract:
This study has as objective to investigate the approach to the family in the context of the Tutelary Council of the city of Fortaleza - Ceará, as well as to verify the understanding of the family as a system; observe the participation of the Guardianship Council in the approach to families; identify essential aspects of the policy of operation of the Tutelary Councils and; historical analyzes about family, childhood and adolescence. In addition to bibliographical and documentary research, a field research with a qualitative approach was carried out; and interviews with several interlocutors: guardianship counselors, the Municipal Council for the Defense of the Rights of Children and Adolescents, the Foundation of the Child and the Citizen Family, the Public Ministry of the State of Ceará and the Pastoral of the Minor. This research was built around an introduction, four (4) chapters and a conclusion. The introduction addresses core issues of the Guardianship Council and family. In the first chapter, I highlight the movement to extend representative democracy to grassroots democracy. The Tutelary Councils are conceived as one of the spaces of change in the direction of a democratic public sphere. The second chapter deals with the definitions of the family throughout the decades and their transformations; the participation of the Guardianship Council in the approach to families and their connection with the right to Family and Community Coexistence of children and adolescents. The third chapter consists of the regulatory factor of the Guardianship Council of the Municipality of Fortaleza. The fourth and final chapter addresses the discussions about the role of the tutor and his / her understanding of the family in the system; the functions attributed to the position and its main difficulties; the essential aspects for the functioning of the Guardianship Council; the counselor-family-institution interaction and the care policy.
