POLÍTICAS PÚBLICAS DE ESTADO NA ERRADICAÇÃO DO SUB-REGISTRO CIVIL DE NASCIMENTO

Resumo:
A referida pesquisa tem por escopo realizar trabalho acadêmico sobre o registro civil das pessoas naturais, numa análise de sua função social, especialmente, como instrumento de cidadania. Traz indicadores sociais que evidenciam a problemática do sub-registro de nascimento, realidade brasileira capaz de levar crianças e adultos à margem da proteção do Estado. Inicia-se pela formação do Estado Moderno, a partir dos autores clássicos contratualistas: Thomas Hobbes, John Locke e Jean- Jacques Rousseau. Desenvolve a temática do registro de nascimento e suas especificidades, considerado o primeiro ato da pessoa natural, por meio do qual adquire um nome com o qual passa a se identificar. Discorre sobre o papel do Estado na garantia dos direitos fundamentais e na concretização do princípio da dignidade da pessoa humana como fundamento do Estado Democrático de Direito. Propõe uma reflexão sobre políticas públicas no processo de erradicação do subregistro. Palavras-chave: Registro civil de nascimento. Cidadania. Erradicação do subregistro. Estado. Abstract:
The scope of the present study is to perform an academic work on civil registration of individuals by means of the analysis of its social role, in particular, as a citizenship instrument. Social indicators have been used to highlight the problem of birth underregistration, which constitutes a Brazilian reality that may lead both children and adults to being marginalized by the State. Civil registration has its roots on the formation of the modern State, from the studies of classical contractualist theorists: Thomas Hobbes, John Locke and Jean-Jacques Rousseau. In this study, we ponder on birth registration and its specificities since it is considered to be the first act of an individual wherewith he or she can assume personality and the right to individuality. We discuss about the role of the State in regard to ensure fundamental rights and the fulfilment of the Principle of Human Dignity as a foundation of the Democratic State of Law. Furthermore, we propose a reflection on public policies in the process of eradication of under-registration. Key words: Birth civil registration. Citizenship. Under-registration eradication. State.
