LICITAÇÕES SUSTENTÁVEIS: OS PARÂMETROS DO DESENVOLVIMENTO NACIONAL E O CONTROLE DAS COMPRAS PÚBLICAS NO ESTADO DO CEARÁ

Resumo:
Nas últimas décadas a busca do meio ambiente equilibrado vem ocupando cada vez mais espaço nas agendas dos governos, nacional e internacional, na tentativa não apenas de reduzir os impactos já causados à natureza, mas de remodelar os hábitos consumeristas da sociedade, incorporando práticas ecológicas no cotidiano público-privado. É nesse contexto que emerge a ferramenta das licitações sustentáveis, instrumento tradicional na rotina administrativista reestruturado de acordo com o princípio constitucional da solidariedade intergeracional, desdobramento lógico da dignidade de pessoa humana. A nova redação do art. 3º da Lei nº 8.666/1993, englobando a promoção do desenvolvimento nacional sustentável como terceira finalidade do microssistema das aquisições governamentais, inaugura um moderno ciclo ético-ambiental na gestão pública brasileira, transformando a postura estatal de espectador para interventor, utilizando sua posição de grande consumidor e empregador para influenciar o mercado, alterando os padrões econômicos de negociação entre os atores sociais direta e indiretamente envolvidos. Essa pesquisa tem como escopo realizar uma investigação teórica e prática sobre as licitações e contratos administrativos à luz da sustentabilidade, analisando os parâmetros objetivos traçados e as políticas públicas realizadas visando a promoção do desenvolvimento nacional. Na exposição desse trabalho, que alberga pesquisas bibliográficas, documentais e jurisprudenciais, será possível verificar os principais impactos advindos pela Medida Provisória nº 495/2010, posteriormente convertida na Lei nº 12.349/2010, no rito das contratações públicas, inovação normativa responsável pela mudança no diálogo entre as gerações atuais e futuras, demonstrando a necessidade de explorar com responsabilidade todas as formas de recursos naturais, respeitando a cadeia sucessiva do ecossistema, preservando a continuidade da espécie humana. Ao final, foi possível concluir que a modificação legislativa ultrapassa a fronteira simplória da normatização licitatória, mas consolida o procedimento das compras governamentais como instrumento estatal de política pública, sobretudo na esfera da preservação ambiental. Essa inclinação brasileira pela inclusão de ferramentas sustentáveis no ambiente público segue a tendência mundial pelo reconhecimento jurídico-constitucional do Estado Socioambiental de Direito, estabelecendo critérios e limites à interpretação normativa, possibilitando o controle daquilo que se entende por desenvolvimento nacional. Abstract:
In the last decades, the search for a balanced environment has been increasingly occupying the national and international agendas of governments, in an attempt not only to reduce the impacts caused to nature, but to reshape the consumer habits of society, incorporating ecological practices in the public-private daily life. It is in this context that the tool of sustainable biddings emerges, a traditional instrument in the administrative routine that has been remodeled in accordance with the constitutional principle of intergenerational solidarity, a logical unfolding of the dignity of human person. The new provision art. 3º of Law nº 8.666/1993, including the promotion of sustainable national development as the third purpose of the government procure micro-system, inaugurates an ethical-environmental cycle in Brazilian public management, transforming the position of the state from viewer to intervener, using its position as a major consumer and employer to influence the market by changing the economic patterns of negotiation between the social actors directly and indirectly involved. This research aims to carry out a theoretical and practical investigation on the licitations and administrative contracts in the light of sustainability, analyzing the objective parameters drawn and the public policies carried out aiming at the promotion of the national development. In the exposition of this work, which owns bibliographical, documentary and jurisprudential research, it will be possible to verify the main impacts arising from Provisional Measure nº 495/2010, later converted into Law nº 12.349/2010, in the rite of public contracts, normative innovation responsible for change in dialogue between present and future generations, demonstrating the need to fully explore all forms of natural resources, respecting the successive chain of the ecosystem, preserving the continuity of the human species. In the end, it was possible to conclude that the legislative change goes beyond the simple border of the bidding rules, but it consolidates the procedure of government procure as a public policy instrument, especially in the sphere of the environmental preservation. This Brazilian inclination for the inclusion of sustainable tools in the public environment follows the worldwide tendency for the legal-constitutional recognition of the Socio-environmental State of Law, establishing criteria and limits to normative interpretation, allowing the control of what is understood by national development.
