DESAFIOS DA DESAPROPRIAÇÃO COMO INSTRUMENTO DE GESTÃO: O CASO DA CONSTRUÇÃO DA CE 010 NA APA SABIAGUABA

Este estudo desenvolve uma análise sobre os desafios da desapropriação como instrumento de gestão, a partir de uma pesquisa sobre a repercussão da construção de uma rodovia intermunicipal na Área de Proteção Ambiental da Sabiaguaba, em Fortaleza, Ceará. Buscou-se compreender junto a um segmento de moradores, qual o impacto da obra de duplicação e pavimentação da rodovia CE 10 para eles e para a comunidade. A pesquisa aponta aspectos da evolução da ocupação urbana da Sabiaguaba, contextualizando-a na história de Fortaleza a partir da ação das políticas de urbanização. Discorre sobre o direito à propriedade, sua função social e a desapropriação para utilidade pública e sua interferência para a concretização de políticas públicas. A questão urbana é vista sob a ótica da Constituição Federal de 1988 que dedica o Título VII e o Capítulo II ao tema, oferecendo um instrumental para a efetivação da propriedade diante do escopo de uma política de desenvolvimento urbano. Também é evidenciado o papel do Poder Judiciário do Ceará, tomando como referência a Comarca de Fortaleza nas questões envolvendo o estado do Ceará, o município de Fortaleza e suas respectivas autarquias, fundações e empresas públicas; na condição de autores ou réus. Os dados contextuais advêm do Departamento de Estradas e Rodagens do Ceará (DER), do plano Fortaleza 2040, da Secretaria de Urbanismo e Meio Ambiente do Município de Fortaleza (SEUMA) e do Instituto de Pesquisa e Estratégia Econômica do Ceará (IPECE). Informações qualitativas foram obtidas através de entrevistas com dois líderes comunitários e 10 moradores do bairro Sabiaguaba. Nas conclusões, verificamos que a obra levou a população a pugnar por outras políticas públicas consideradas essências como saúde, segurança e lazer. Foi possível confirmar a importância das desapropriações, como também perceber a dissonância entre os objetivos da intervenção pública e a opinião dos habitantes do bairro. Em suma, foi possível compreender a especificidade da desapropriação como instrumento de gestão urbana, bem como uma obra pública age como um motor tanto para o desenvolvimento econômico, quanto para despertar na população uma postura de ativação da cidadania. Abstract:
This study develops an analysis on the challenges of expropriation as a management tool, based on a research on the impact of the construction of an intercity highway in the Sabiaguaba Environmental Protection Area, in Fortaleza, Ceará, Brazil. It was sought to understand together with a segment of residents, what the impact of the duplication and paving work of the CE 10 highway for them and for the community. The research points out aspects of the evolution of the urban occupation of Sabiaguaba, contextualizing it in the history of Fortaleza from the action of urbanization policies. It discusses the right to property, its social function and expropriation for public utility and its interference in the implementation of public policies. The urban question is seen from the point of view of the Federal Constitution of 1988, which dedicates Title VII and Chapter II to the theme, offering an instrumental for the realization of the property before the scope of an urban development policy. It is also evidenced the role of the Judicial Power of Ceará, taking as reference the Fortaleza region in matters involving the state of Ceará, the municipality of Fortaleza and their respective municipalities, foundations and public companies; in the condition of authors or defendants. The contextual data come from the Department of Roads and Roadworks of Ceará (DER), the Fortaleza 2040 plan, the Department of Urbanism and Environment of the Municipality of Fortaleza (SEUMA) and the Institute of Research and Economic Strategy of Ceará (IPECE). Qualitative information was obtained through interviews with two community leaders and 10 residents of the Sabiaguaba neighborhood. In the conclusions, we verified that the work led the population to strive for other public policies considered essences such as health, safety and leisure. It was possible to confirm the importance of expropriations, as well as to understand the dissonance between the objectives of public intervention and the opinion of the inhabitants of the neighborhood. In short, it was possible to understand the specificity of expropriation as an instrument of urban management, as a public work acts as an engine for economic development as well as to awaken in the population a posture activation of citizenship.
