A Implementação da reforma psiquiátrica em Fortaleza Ceará: contexto desafios e perspectivas

Resumo:
Trata-se de pesquisa qualitativa e descritiva, com perspectiva histórica,
fundamentada em estudo referente à análise da implementação da Política de
Saúde Mental no Município de Fortaleza-CE, no contexto do Movimento Brasileiro
de Reforma Psiquiátrica, com recorte no período 2001/2008. Por primeiro, cuidou-se
de delimitar o objetivo geral da pesquisa, considerando-se a implementação da Lei
nº 10.216/01 (Lei da Reforma Psiquiátrica Brasileira), na conjuntura da atenção à
saúde mental vigente no Município de Fortaleza-CE, tendo-se em perspectiva a
saúde mental como direito constitucional e legal, além de se traçar esboço de
comparação histórica com a reforma psiquiátrica em andamento no Brasil e no
Ceará. Em termos de objetivos específicos da pesquisa, estabeleceu-se o exame da
intervenção do Ministério Público no campo da saúde mental, tomando-se por
princípio o conceito jurídico de saúde e a defesa dos direitos de liberdade e da
dignidade da pessoa humana; fixou-se o histórico da reforma psiquiátrica no
Município de Fortaleza, no recorte temporal 2001/2008; bem como se procurou
oferecer contribuição ao aperfeiçoamento da reforma em referência na Capital do
Estado do Ceará. Como metodologia da pesquisa, utilizou-se da análise bibliográfica
e dos dados obtidos através de entrevistas, cujos participantes foram Gestores da
Saúde (GS), Coordenadores de CAPS (CC), membros do Controle Social (CS) e
Dirigentes Hospitalares (DH). No Capítulo I, a abordagem foi construída por meio do
conceito jurídico de saúde na Constituição Federal de 1988 e do conceito
constitucional de relevância pública na saúde, com a preocupação de abrir espaços
para a interdisciplinariedade das questões, ora do ponto de vista da saúde, ora do
ponto de vista jurídico. Entendeu-se pertinente discorrer sobre as internações
psiquiátricas e a segregação dos indivíduos, na órbita da defesa dos direitos e da
dignidade da pessoa humana, trazendo à luz, também, o entendimento jurídico a
respeito dos institutos da capacidade e da incapacidade no contexto do Direito Civil
e da vida. Foi, também, objeto de apreciação a intervenção do Ministério Público na
tutela do direito de liberdade frente às internações psiquiátricas involuntárias. No
Capítulo II, apresentou-se retrospectiva histórico-social sobre o movimento de
assistência psiquiátrica no Brasil, no Ceará e em Fortaleza, trabalhando a
contextualização da Lei nº 10.216/2001 (Lei de Reforma Psiquiátrica). E, finalmente,
no Capítulo III, explicitou-se a análise da fala dos sujeitos, levando-se em
consideração a recorrência à luta antimanicomial, como substitutivo do rigor, e a
explicação das precariedades. Do conjunto da pesquisa, restaram apresentados os
desafios a serem enfrentados pelos diversos setores, para que ocorra o
aperfeiçoamento da reforma psiquiátrica no município de Fortaleza, com as
recomendações direcionadas ao Poder Público, aos Profissionais de Saúde e à
Sociedade.

Abstract:
This is a qualitative and descriptive research, with historical perspective, grounded in
study about the analyses of mental health politics in the city of Fortaleza, in the
context of Brazilian Movement of Psychiatric Reform, period 2001/2008. At first, the
concern was to delimit the general objective of the research, considering the
implementation of the Law No 10.216/01 (Brazilian Psychiatric Reform Law), in the
conjuncture of health mental attention in the district of Fortaleza, in order to view the
mental health as a constitutional and legal right, and also outline the historical
comparison with the psychiatric reform running in Brazil and in Ceará. As specifics
objectives of the research, it was fixed the exam of the Public Ministry (or State
Public Prosecutor) intervention in the field of mental health, bringing health juridical
concept and the defense of the liberty and dignity rights of the human being; it was
assigned the psychiatric reform historical in the district of Fortaleza, period
2001/2008; as well as it was considered important to offer contribution in order to
improve the mentioned reform in the state capital of Ceará. As a research
methodology, it was used the bibliographical analyses and data obtained from
interviews with health managers, CAPS coordinators, members of the social control
and hospital managers. In Chapter I, the course of action was built by giving the
health juridical concept according to the Federal Constitution of 1988 and also the
constitutional concept of public relevance in health, with the concern to open spaces
for the inter-disciplinary envolvement of the questions, both in the health view and in
the juridical view. It became understood that was appropriate discourse about the
psychiatric confinements and individual segregations in the perspective to defend the
rights and dignity of the human being, by also bringing to light the understanding
about the institutes of capacity and incapacity in the context of the Civil Law and life
itself. It was likewise object of appraisal the Public Ministry intervention for the
protection of the liberty right, due to involuntary psychiatric confinements. In Chapter
II, It was shown a social-historical retrospective about the psychiatric assistance
movement in Brazil, in Ceará and in Fortaleza, in view of the Psychiatric Reform Law
(No 10.216/2001). And finally, in Chapter III, it took place the analyses of the
speeches, taking into consideration the fight for no more psychiatric confinement in
mental hospital, as a substitutive for the rigidity, and the explanations of
precariousness. As a result of the research, came up the challenges to be faced by
the different sectors, so the psychiatric reform in the district of Fortaleza can be
improved, with the recommendations to the Public Power, to the workers in the
health system and to the society.
