Resumo:
É notório que o ambiente das instituições que cumprem a medida de internação não tem demonstrado ser eficientes na função de promover a ressocialização dos adolescentes e de maneira precária acabam se tornando espaços onde a socialização acontece com graus elevados de violação de direitos através da violência institucional. Diante disso, o principal objetivo desta pesquisa foi analisar a influência da escola na prevenção de reincidências infracionais, através da ressocialização dos adolescentes infratores internados. Quanto a natureza da pesquisa foi utilizada uma verificação qualitativa, por ser uma abordagem subjetiva do objeto e de seus sujeitos, com intuito de investigar comportamentos diante da realidade e não contabilizar quantidades como resultado. A pesquisa também teve caráter explicativa, possibilitando uma conexão de percepções e entendimento da realidade pesquisada, através da identificação e compreensão dos fatores que promovem os principais impactos e as razões que explicam a temática abordada.A fundamentação da pesquisa foi um estudo de caso,porque requer uma coleta e análise de dados mais rigorosa e aprofundada, que possibilitou a comprovação de uma variedade de fatores que incidem com resultados bastantes complexos, com conotações subjetivas de compreensão, daí a necessidade de estudar seriamente. Para desenvolver o entendimento da temática abordada nesta pesquisa, esta dissertação está dividida em quatro capítulos onde o primeiro capítulo vai abordar a trajetória das políticas criadas no sentido de atender e garantir a defesa da criança e do adolescente, no âmbito internacional e nacional, mostrando os avanços alcançados até a promulgação do Estatuto da Criança e do Adolescente, o ECA. Os princípios que encaminham e orientam as medidas, juntamente com a análise dos sistemas de proteção e garantias de direitos, serão discutidos no segundo capítulo, fazendo um acompanhamento teórico das legislações brasileiras em relação a infância e juventude. Já no terceiro capítulo será abordada o direito à educação na medida socioeducativa, discutindo a importância da escola, fazendo um paralelo entre os avanços e desafios no processo de ensino nos centros de internação.Por fim, no quarto e último capítulo será tratado as compreensões da investigação da pesquisa, iniciando por uma abordagem histórica da Fundação da Criança e do Adolescente (FCRIA) e da Escola estadual Elcy Lacerda. Foi analisada neste capítulo a atuação dessas instituições na contribuição para o processo de
ressocialização e prevenção de reincidência desse jovem cumprindo medida de privação de liberdade. Como resultado, constatou-se que a educação para ser inclusiva carece compor um tratamento inovador, norteando as ações pedagógicas com vista à superação das práticas de ensino tradicionais e impositivas de punição.

Abstract:
It’s notorius that the instiutions’ environment which offers detention sentences, doesn’t have shown to be effective on its function, of promote the adolescent’s resocialization, also, in a precarious way turns out to being spaces which socialization, happens with high levels of rights violation through intitutional violence. The principal goal of this research was to explain the school institution’s function in the context of prevent, social reintegration through the young offender’s resocialization who fullfill social-educational detention sentences. As for the nature of the research, a qualitative verification was used, as it is a subjective approach of the object and its subjects, in order to investigate behaviors before reality and not to account for quantities as a result.The research also had explanatory character, allowing a connection of perceptions and understanding of the researched reality, through the identification and understanding of the factors that promote the main impacts and the reasons that explain the approached theme. The basis of the research was a case study, because it requires a more rigorous and in-depth data collection and analysis, which made it possible to prove a variety of factors that affect quite complex results, with subjective connotations of understanding, hence the need to study seriously. In order to develop understanding of this research theme, this dissertation it is divided into four chapter where the first chapter will show the trajectory of the policies created in order to answer and guarantee defense above children and teenagers, internationally and nationally, showing the advances reached since the ECA’s promulgation. The principals which guide the sentences, along with the protection system analyzis, will be discussed on the second chapter, making a theoretical follow up of the brazillian laws related to children and teenagers. On the third chapter, it will be approached the right to education into the socio-educational sentence, discussing the school importance, making a comparisson between the advances and challenges on learning process into the detention centers. Lastly, on the fourth chapter will show conclusions about the research, starting from a historical approach about the Foundation of Child and Adolescent – ―FCRIA‖ in portuguese, and the Elcy Lacerda’s school. It was analyzed in this chapter the acting of these institutions on the cuntribution for the resocialization process and recurrence prevention of this young person fulfilling detention sentence. As result, it was found that the education to be inclusive needs to create a innovative treatment guiding the pedagogical actions in order to overcome the traditional way.
