ILEGITIMIDADE DA POLÍCIA PARA CELEBRAR ACORDO DE COLABORAÇÃO PREMIADA SEM A EFETIVA PARTICIPAÇÃO DO MINISTÉRIO PÚBLICO

Resumo:
O objetivo do presente trabalho é defender a impossibilidade da polícia judiciária em celebrar acordo de colaboração premiada sem a efetiva participação do Ministério Público diante da titularidade exclusiva da ação penal pública dada pelo constituinte originário ao Parquet. Para tanto, será necessário entender o conceito do instituto, sua natureza jurídica, a evolução da justiça negociada no ordenamento jurídico brasileiro, bem como os seus aspectos procedimentais. Será feito um estudo propositivo da constitucionalidade da Lei nº 12.850/13, sendo necessário analisar, à luz do sistema acusatório, as disposições previstas no artigo 4º, §§ 2º e 6º da referida lei, que confere ao delegado de polícia o poder de, em sede de investigação, firmar acordo de colaboração premiada, buscando demonstrar o conflito aparente entre os citados dispositivos e as diversas previsões constitucionais sobre o tema. Será analisado o posicionamento adotado pelo Supremo Tribunal Federal na Ação Direta de Inconstitucionalidade nº 5058/DF e as consequências do entendimento firmado na Corte Constitucional. O trabalho possui relevante interesse acadêmico eis que o assunto é novo no direito brasileiro, carecendo, portanto, de estudo mais aprofundado sobre a matéria.

Abstract:
The aim of the present research is to defend the impossibility of the judicial police to take part in cooperation agreement without the effective participation of the Public Prosecution Service in the face of the exclusive ownership of the public criminal action given by the original constituent to Parquet. It will be necessary to understand the concept of the institute, the legal nature, the evolution of justice negotiated in the Brazilian legal system, as well as its procedural aspects. A study of the constitutionality of Law No. 12.850 / 13 will be made, and it is necessary to analyze, in the light of the accusatory system, the provisions set forth in article 4, §§ 2 and 6 of said law, which gives the police officer the power, in order to demonstrate the apparent conflict between the aforementioned provisions and the various constitutional provisions on the subject. It will analyze the position adopted by the Federal Supreme Court in the Direct Action of Unconstitutionality no 5058 / DF and the consequences of the understanding signed in the Constitutional Court. The research has a relevant academic interest, since the subject is new in Brazilian law, requiring, therefore, a more in-depth study on the subject.
