A CUSTÓDIA DE PRESOS REALIZADA NAS DELEGACIAS DE POLÍCIA CIVIL DO CEARÁ

Este trabalho teve por objetivo estudar o processo de custódia de presos realizada nas dependências de delegacias de polícia civil do estado do Ceará. Foram pesquisadas as implicações de tal custódia, sob a perspectiva dos direitos human os desses encarcerados, sobretudo no que tange ao princípio maior da dignidade da pessoa humana, onde foi examinado se mencionados direitos estão sendo violados. O estudo tratou ainda da problemática que envolve o aspecto da execução do serviço de custódia de presos, em repartições policiais, desenvolvida por servidores públicos pertencentes ao quadro de carreira da polícia judiciária, bem como investigou se ocorre desvio de função pública quando esses profissionais da Segurança Pública se ocupam da aludida tarefa. A pesquisa analisou também, como o assunto é enfocado pela Constituição Federal/1988, pela legislação infraconstitucional brasileira em vigor, assim como pelos tratados internacionais de direitos humanos de que o Brasil é signatário, e expôs algun s pontos relevantes respeitantes ao tema, como a violência, a criminalidade, a Segurança Pública, o Sistema Prisional e acerca das funções institucionais da polícia judiciária, delimitando as atribuições que lhes são pertinentes. Foram relatadas também alg umas consequências resultantes da prática dessa custódia, seus reflexos na Segurança Pública e, por fim, foi descrita a importância da elaboração e implementação de Políticas Públicas voltadas para a resolução desse fenômeno. Para que o objetivo fosse alca nçado, foi feita uma pesquisa descritiva, consubstanciada, sobretudo, por material bibliográfico, constituído a partir de livros, artigos científicos, impressos de periódicos, jurisprudências, e legislações pertinentes, além de materiais extraídos da inter net. Destaque se que, com o fito de obter o maior número de informações possíveis sobre a problemática em estudo, bem como visando confrontar o aspecto teórico com os dados da realidade, foi traçado um modelo conceitual e operativo da pesquisa, baseada em uma bibliografia eclética que procurou citar o posicionamento de autores que tratam do assunto sob as mais diversas óticas, como Sérgio Adorno (1995, 1996 e 2000), David Bayley (2001), Glaucíria Brasil (2000), Uadi Lammêgo Bulos (2002), Fernando Capez ( 200 8 ), Carvalho Filho (2002 e 2006), Cretella Jr (1999), Nobert Elias (1997, 2001, 2002 e 2008), Michel Foucault (1995, 1999 e 2004), Rogério Greco (2009), Pedro Lenza (2008), Hely Lopes Meirelles (2001), Julio Fabbrini Mirabete (2007), José Afonso da Silva ( 2004 ), dentre Palavras chave: Custódia de presos Delegacias de polícia Direitos humanos Desvio de função pública.
Abstract:
This paper aims to analyze the process of custody of prisoners held in the premises of police stations in the State Civ il Police of Ceará, for that, it was investigated the implications of such custody, from the perspective of human rights of those incarcerated, especially regarding the supreme principle of human dignity, even it was examined whether those rights are being violated. The study sought also to deal with the problems involved in the execution of the service aspect of the custody of prisoners in police departments, developed by civil servants that belong to the career of the Judicial Police and investigated whet her there is misuse of the public when these Professional Public Safety engage the mentioned task. The research sought to highlight, too, as it is focused by the Constitution Federal/1988, the Brazilian constitutional legislation in force, as well as by in ternational human rights treaties to which Brazil is a signatory, and exposed some relevant points relating to the topic, as violence, crime, Public Safety, the prison system and about the institutional functions of the Judicial Police, outlining the assig nments that are relevant to them. Were reported also some practical consequences of this custody, their reflections on Public Safety and, finally, sought to describe the importance of the development and implementation of public policies aimed at the resol ution of this phenomenon. To that goal was achieved, there was a descriptive research with documentary analysis, based mainly on bibliographical material, composed from books, scientific papers, printed periodicals, case law, and local and national as well as materials extracted the internet. We highlight, with the aim to get as many information as possible about the problem under study, as well as aiming to confront the theoretical aspect with the data of reality, was drawn a conceptual and operational res earch model, based on an eclectic bibliography which sought to cite the position of authors dealing with the subject under different optical, like Sérgio Adorno (1995, 1996 and 2000), David Bayley (2001), Glaucíria Brasil (2000), Uadi Lammêgo Bulos (2002), Fernando Capez (2008), Carvalho Filho (2002 and 2006), Cretella Jr (1999), Nobert Elias (1997, 2001, 2002 and 2008), Michel Foucault (1995, 1999 and 2004), Rogério Greco (2009), Pedro Lenza (2008), Hely Lopes Meirelles (2001), Julio Fabbrini Mirabete (200 7), José Afonso da Silva (2004), among others.
