LICITAÇÕES COMO POLÍTICAS PÚBLICAS DE REDUÇÃO DE DESIGUALDADES: UM ESTUDO DO ESTATUTO DAS PEQUENAS EMPRESAS DO MUNICÍPIO DE FORTALEZA

Resumo:
A presente dissertação investiga a utilização do poder de compra governamental em políticas públicas voltadas à redução das desigualdades sociais e econômicas e estímulo ao desenvolvimento local, a partir da geração de discriminações positivas em favor das Microempresas e Empresas de Pequeno Porte – MPEs, com especial atenção à aplicação das normas de tratamento diferenciado e simplificado ao segmento, pelo Município de Fortaleza, nas licitações que promove. Trata-se de estudo descritivo, cuja metodologia utilizada reúne a busca de conhecimento teórico por meio de pesquisa prioritariamente bibliográfica, mediante consulta a fontes legislativas, doutrinárias, jurisprudenciais, livros, artigos, periódicos, boletins, revistas especializadas e de dados oficiais de licitações do Município publicados na Internet e em outros meios. A importância do trabalho se insere no reconhecimento, de um lado, do poder de compras estatal e, de outro, que grande parte das aquisições públicas, nos últimos anos, se deu junto às MPEs, cuja importância foi reconhecida em nossa Constituição Federal, onde são erigidas à condição de princípio da ordem econômica. Além disso, por estarem situadas em todos os municípios brasileiros, se revelam as pequenas empresas como relevantes instrumentos para a modificação de realidades, vindo o Estado, mediante atuação interventiva na economia, a conferir ao segmento, através da LC 123/2006, discriminações positivas em diversos aspectos, notadamente na seara das licitações públicas. Com as modificações introduzidas no Estatuto nacional das MPEs pela LC 147/2014, tornou-se obrigatória a concessão, pelos entes públicos, das normas de tratamento simplificado e diferenciado, contexto em que o Município de Fortaleza publicou o Estatuto municipal das MPEs e o regulamento respectivo, promovendo o redesenho do processo de compras públicas e aprimorando os editais de licitações e o julgamento destas, vindo a cumprir a finalidade social da norma, intrinsecamente ligada à minoração do quadro de desigualdades.

Abstract:
The present dissertation investigates the use of State's buying power in the public policies related to the reduction of socioeconomic inequality and local development, using positive discriminations in favor of micro and small companies, with special attention to the differentiated and simplified standards applied to the them by the city of Fortaleza on it's government acquisition process. This is descriptive study, the methodology meets the pursuit of theoretical knowledge through priority bibliographical research by consulting the legislative sources, doctrinal, jurisprudential, books, articles, periodicals, newsletters, journals and official data bids of municipality published on the Internet and in other media.The importance of this paper is, on one hand, in the recognition of the state's buying power, and, on the other hand, in the fact that a large proportion of the public acquisition over the last years was made with micro and small companies, whose importance was recognised in the Constitution, in which they are guaranteed as economic order's principle. Besides, beeing present on all brazilian counties, the small companies revel themselves as relevant reality modifiers instrument, as the State, using economic intervention measures, instituted the legislation (LC 123/2006), which brought positive discriminations in several aspects, including the government acquisition process. After the modifications brought by the LC 147/2014 to the legislation that rules micro and small companies, it became mandatory to public organs the compliance to the differentiated and simplified standards. In these scenario, the city of Fortaleza instituted a local act in regard to micro and small companies, promoting a redesign and optimization in the public acquisition process, fulfilling the social objective intended by the law, beeing deeply close to the reduction of inequalities.
