A OBRIGATORIEDADE DA TEMÁTICA HISTÓRIA E CULTURA AFRO-BRASILEIRA E INDÍGENA NA REDE DE ENSINO: UM ESTUDO SOBRE A IMPLEMENTAÇÃO DA LEI Nº 11.645/08 NO CONTEÚDO PROGRAMÁTICO DAS ESCOLAS PÚBLICAS DE CAUCAIA

Resumo:
O ensino da temática “História e Cultura Afro-Brasileira e Indígena” se faz obrigatório nos estabelecimentos de ensino públicos e privados, a partir da sanção da Lei Nº 11.645, de 10 de março de 2008, que altera a Lei Nº 9.394, de 20 de dezembro de 1996, que estabelece as diretrizes e bases da educação nacional. A implementação da Lei sancionada, tem por objetivo difundir as culturas negra e indígena no âmbito da formação da sociedade brasileira. Esta pesquisa trata de questões inerentes a aplicabilidade da referente Lei nos ambientes escolares, buscando a compreensão das conquistas relativas ao processo da formação de identidade cultural da sociedade nacional. Para tanto, foi feito um estudo quali-quantitativo, com aplicação de questionários aos alunos, do 8º e 9º ano, de duas escolas, localizadas no Município de Caucaia, no Estado do Ceará, onde também, através de visitas externas foi possível proferir um estudo por meio da observação. A obrigatoriedade do ensino das temáticas propostas pela Lei implica a necessidade de abordagem na docência de todas as disciplinas do currículo da educação básica, que inclui o ensino fundamental e médio. Ao observar as grades curriculares do ensino fundamental dos anos finais, das escolas municipais de Caucaia, foi possível constatar que se faz alusão apenas à Lei 10.639, de 09 de janeiro de 2003, que também altera a Lei de Diretrizes e Bases da Educação Nacional, visando a inclusão da temática afro-brasileira, sem menção referente a questão indígena. Foi possível observar o desconhecimento dos educadores e da comunidade escolar acerca da Lei e da obrigatoriedade dos seus estudos e, portanto, o despreparo para difundir tais saberes ou lidar com questões relativas a discriminação e ao preconceito, presentes no cotidiano dos alunos. A legislação existente é essencial para o exercício das políticas públicas que contribuam para a diminuição das desigualdades sociais, no entanto, não existe eficácia em sua implementação, devido a inexistência do preparo dos educadores escolares para colocá-la em prática de forma efetiva.

Abstract:
The teach of the theme "History and Culture Afro-Brazilian and Indigenous" is made required in public and private schools, from the sanction of Law No. 11.645, of 10 March 2008, amending Law No. 9.394 of 20 December 1996, that establishes the guidelines and bases of national education. The implementation of this law aims to spread the black and indigenous cultures in the formation of Brazilian society. This research deals with issues relating to the applicability of the related Law in school environments, searching to understand the achievements concerning the process of cultural identity formation of national society. That way, it was made a qualitative and quantitative study with questionnaires applied to students, of the 8th and 9th year, at two schools, located in the city of Caucaia, in the state of Ceará, where also through external visits was possible execute a study through observation. The mandatory education of the themes proposed by Law implies the need to approach the teaching of all subjects in the curriculum of basic education, which includes primary and secondary education. Observing the curriculum of elementary school of the final years of municipal schools in Caucaia, it was found that it mentions only to the Law 10.639 of 09 January 2003, which also amends the Law of Guidelines and Bases of National Education, aiming at the inclusion of Afro-brazilian theme, without mention of indigenous questions. It was possible to observe the lack of knowledge of teachers and the school community about the law and the requirement of their studies, and therefore the lack of prepare to spread that knowledge or dealing with questions about discrimination and prejudice present in the students lives. The existing legislation is essential to the exercise of public policies that contribute to the reduction of social inequalities, however, there is not effectiveness in implementation because exist the lack of preparation of school teachers to put it into practice effectively.
