A CONTRIBUIÇÃO DO PODER LEGISLATIVO DO ESTADO DO CEARÁ ÀS POLÍTICAS PÚBLICAS DE TURISMO

Resumo:
Esta dissertação analisa a contribuição do Poder Legislativo Estadual do Ceará ás políticas públicas de turismo. O estudo considera a atuação do Parlamento Estadual Cearense a partir do Governo das Mudanças, final da década de 1980 até a contemporaneidade. Analisam-se as leis cearenses referentes ao turismo discutidas no espaço democrático da Assembleia Legislativa do Estado do Ceará e o trâmite do processo legislativo para elaboração das normas constitucionais. O foco das investigações envolve relações entre os Poderes Legislativo e Executivo cearense nas estratégias definidas no exercício dos dois poderes. A pesquisa adota metodologia exploratória e abordagens quantitativas e qualitativas. As categorias de analise para embasamento teóricos foram os conceitos: turismo, políticas públicas, legislação, poderes da república, política de turismo, leis de turismo no Estado do Ceará, e os teóricos estudados foram: Paiva (1979), Bourdieu (1989), Santos (1996), Coriolano (1998), Beni (2001), Moraes (2002), Silva (2003) e Azambuja (2007). Constata-se 44 leis relacionadas ao turismo trabalhadas no Poder Legislativo Estadual Cearense, porém, a legislação vigente que poderia oferecer oportunidade igual para os sujeitos envolvidos nas atividades turísticas ainda precisa contribuir com maior determinação para que as políticas públicas possam dar sustentabilidade ao desenvolvimento da atividade. Há conflito de interesses entre os poderes Executivo e Legislativo que dificultam a otimização dos processos e a elaboração das leis. Há omissões nas discussões e proposições em relação às significativas demandas do turismo no Ceará. Embora o Poder Legislativo Estadual cearense possua serviços que promovam discussões acerca do turismo, as políticas públicas de turismo ainda são incipientes no que se refere à importância da atividade turística como fonte geradora de desenvolvimento econômico e social para o Ceará, um Estado que espera muito do turismo. Abstract:
This dissertation analyzes the contribution of the Legislative State Power of the State of Ceará to the public policies of tourism . The study considers the performance of the Parliament of the State of Ceará from the Government of Changes, at the end of the 1980s until the present. It examines the laws relating to tourism in Ceará discussed at the democratic space of the Legislative Assembly of the State of Ceará and the way of the legislative process for the elaboration of constitutional norms. The focus of the investigations involves relations between the legislative and executive powers of Ceará in the strategies defined in the performance of the two powers. In the analysis of public policies of tourism takes into account the variables operationalized by parliamentarians and the head of the executive power, subjects involved in the constitutional production of tourism in Ceará. The research adopts the exploratory methodology and quantitative and qualitative aproaches. The studied theoretical were: Paiva (1979), Bourdieu (1989), Santos (1996), Coriolano (1998), Beni (2001), Moraes (2002), Silva (2003) and Azambuja (2007). A number of 44 laws related to tourism were verified and worked in the legislative State Power of Ceará, so, the present legislation that could offer the same opportunity to the people involved in touristic activities still need to contribute with greater determination in order to the public policies could give sustainability to the development of the activity.It notices the conflict of interests between the executive and legislative powers that hinder the optimization of processes and the elaboration of laws. There are negligences in the discussions and propositions related to the significant demands of Ceará´s tourism. Although the Legislative Power of the State of Ceará has services that promotes discussions about the tourism, the public policies of tourism are still initial regarding the importance of tourism activity as a source of economic and social development to Ceará, a state that hopes a lot from the tourism.
