SISTEMA PRISIONAL DO ESTADO DO CEARÁ: AVALIAÇÃO DAS POLÍTICAS PÚBLICAS DE EDUCAÇÃO

Resumo:
A presente dissertação trata da análise das políticas públicas de educação, no âmbito do Sistema Prisional do Estado do Ceará, que é gerido pela Secretaria de Justiça e Cidadania do Governo Estadual. A análise parte de dados quantitativo e qualitativos, além de documentos e legislações nacionais e internacionais que asseguram a educação em presídios. Os dados qualitativos foram apurados em entrevistas com apenados que estão cumprindo pena de prisão e que participam das atividades de educação no cárcere e com egressos do sistema, que em sua passagem participaram dessas políticas públicas de educação. Os dados quantitativos foram apurados em documentos e pesquisas de diversas instituições, como Ministério da Justiça, Anistia Internacional, Departamento Penitenciário Nacional, Secretaria de Justiça do Governo do Estado do Ceará e órgãos da imprensa.. O objetivo geral foi avaliar as políticas públicas de educação no sistema carcerário cearense, verificando se estas políticas são ofertadas a contento com o disposto na legislação e nas obrigações internacionais. Quanto aos objetivos específicos, destacam-se: a) montar um panorama geral sobre a história da pena e do cárcere, situando os seus elementos históricos, sociais e políticos; b) apresentar as transições da pena e conceituar seus elementos; c) apresentar o direito à educação como um direito fundamental e humano, portanto, ressaltando a impossibilidade de sua negativa às pessoas privadas de liberdade; d) apontar o panorama legislativo brasileiro e cearense sobre a execução penal e o direito à educação; e) verificar se há oferta de políticas públicas de educação no sistema prisional cearense; f) apurar os tipos de educação ofertados no sistema prisional cearense e sua abrangência numérica, além das condições físicas e estruturais para o correto desenvolvimento da política pública de educação; g) apontar as dificuldades para a consecução da oferta de educação no sistema prisional; h) verificar o impacto da educação na vida dos educandos em cumprimento de pena privativa de liberdade e na vida dos egressos. Como resultado, observou-se que no estado do Ceará há um interesse estatal em ofertar educação em presídios, inclusive com melhoras nos índices ao longo dos últimos anos. Porém, verificou-se, também, que a oferta ainda está em quantidade muito inferior ao desejado, além de sérios problemas estruturais que emperram a concretização dessas políticas públicas. Desta forma, conclui-se que, mesmo com o forte empenho dos últimos anos a oferta de educação ainda é precária e precisa de muito estímulo e desenvolvimento para se firmar como política pública consolidada. Abstract:
The present work addresses the analysis of the public policy on education within the scope of the Prison System of the State of Ceará, which is managed by the Justice and Citizenship Secretary of the State Government. The analysis is based on qualitative and quantitative data, as well as documents and national and international legislation which assure the education in penitentiaries. The qualitative data was assessed by means of interviews with inmates that participate in educational activities in prison and with former inmates that have participated in such education public policy. The quantitative data was based in documents and research before several institutions such as Ministry of Justice, International Amnesty, National Penitentiary Department, Secretary of Justice of the State of Ceará and press. The general scope was to evaluate the public policies on education in the penitentiary system of the State of Ceará, verifying if these public policies are satisfactorily offered in compliance with the international legislation and obligations. As to the specific scopes, one may highlight: a) present a general overview on the history of imprisonment penalties and imprisonment, indicating its historical, social and political elements; b) present the transitions of the penalties and define its elements; c) present the right to education as a human and fundamental right therefore highlighting the impossibility of its denial to inmates; d) appoint the legal scenario in Brazil and in the State of Ceará on the criminal conviction enforcement and the right to education; e) verify if there is offer of this public policy on the prison in the State of Ceará; f) assess the types of education offered in the prison system of the State of Ceará and its numbers, as well as the physical and structural conditions for the correct development of the public policy on education; g) appoint the difficulties for the offer of education in the prison system; h) verify the impact of education in the life of current and former inmates. As a result, it was observed that there is an official and formal interest of the State of Ceará in offering education in prison, including improvement of the results in the last years. However, it was verified that the offer is still far below the intended, besides serious structural problems that jeopardize the consecution of these public policies. Therefore, one concludes that even with the strong efforts in the last years the education offer is still precarious and needs a lot of incentives in order to become a consolidated public policy.
