Resumo:
A problemática urbana sob a ótica da regularização fundiária aparenta ser aquém de uma questão meramente sociológica, mas sim de compreensão minuciosa de diversos grupos existentes nos centros urbanos. O objeto de estudo desta pesquisa foi investigar a regularização fundiária em imóveis públicos da União localizados no bairro Pirambu, na costa Oeste de Fortaleza. Dessa forma, o estudo analisa como os personagens participam da consolidação da garantia do direito à moradia no bairro através da regularização fundiária em imóveis públicos urbanos voltados à moradia por meio da medida provisória nº 2.220/2001. A pesquisa examina ainda, como os imóveis públicos da União Federal premidos de uma predisposição habitacional ocupam o espaço urbano de Fortaleza, com especial atenção para o problema de moradia das pessoas de baixa renda que ocupam o bairro Pirambu, analisando para isso, todo o aspecto histórico e sociológico do bairro juntamente com o equilíbrio sustentável aplicado às terras públicas, configurado pela necessidade de titulação dos ocupantes e da busca de estabilização da situação jurídica dos moradores diante do próprio poder público e de terceiros. Nesse contexto, busca-se examinar genericamente toda a matriz principiológica da regularização fundiária urbano até chegar à concessão de uso de imóvel público urbano para fins habitacionais identificado no Pirambu como principal política pública de habitação da população. Para compreender a aplicação da regularização fundiária urbana no Bairro do Pirambu e entender a concessão especial de imóvel público para fins habitacionais como politica pública foi necessário analisar todo o contexto histórico da origem e do desenvolvimento do referido bairro adequando a lei ao espaço e não no sentido contrário.Já com relação a execução da regularização fundiária por parte do poder estatal a presente tese apresenta elementos que podem contribuir para uma qualidade melhor nos resultados de tais ações governamentais.Por fim a pesquisa aponta através de uma analise critica de toda a conjuntura, elementos positivos e negativos acerca do tema Acrescentar resultados, discussão e conclusão. Abstract:
The urban problematic from the point of view of land regularization seems to be a matter of purely sociological question, but of a detailed understanding of various groups existing in urban centers. The object of this research was to investigate the land regularization in public buildings of the Union located in the Pirambu neighborhood, on the west coast of Fortaleza. In this way, the study analyzes how the characters participate in the consolidation of the guarantee of the right to housing in the neighborhood through land regularization in urban public housing properties through provisional measure 2,220 / 2001. The research also examines how the public buildings of the Federal Government, which are depressed by a housing predisposition, occupy the urban space of Fortaleza, with special attention to the housing problem of low income people occupying the Pirambu neighborhood, analyzing for this, the whole aspect Historical and sociological characteristics of the neighborhood together with the sustainable balance applied to public lands, configured by the need for titling of the occupants and the search for stabilization of the legal situation of the residents before the public and third parties themselves. In this context, it is sought to examine generically the entire principiológica matrix of urban land regularization until it reaches the concession of use of urban public property for housing purposes identified in the Pirambu as the main public housing policy of the population. In order to understand the application of urban land regularization in the Pirambu District and to understand the special concession of public property for housing purposes as a public policy, it was necessary to analyze the entire historical context of the origin and development of the said neighborhood, adapting the law to space and not in the sense With respect to the execution of land regularization by the state power, this thesis presents elements that can contribute to a better quality in the results of such governmental actions.
