Resumo:
O objetivo da dissertação é avaliar a contribuição das atividades de um Núcleo de Prática Jurídica em Curso de Direito para a política pública voltada ao direito de acesso à justiça. Com base em pesquisa bibliográfica, a acesso à justiça é analisado quanto ao seu significado, sua contextualização histórica e sua existência vinculada ao modelo constitucional processual de forma a se justificar seu enquadramento como direito fundamental a ser tutelado por meio de políticas públicas. A promoção de políticas públicas brasileiras dedicadas ao acesso à justiça é evidenciada pela análise de normas que se dedicam às suas perspectivas evolutivas, pela explanação da reforma ao Judiciário e suas motivações, e pela abordagem da promoção de políticas jurisdicionais. Focando na perspectiva da assistência jurídica como direito fundamental de prestação de assistência judiciária e de orientação jurídica aos vulneráveis, o trabalho se debruça sobre a Defensoria Pública e os Núcleos de Prática Jurídica com ela conveniados, abordando normas, implantação, motivações e contextualização. Dedica-se a uma descrição de como se apresentam, em seus sites, os núcleos conveniados com a Defensoria Pública em Instituições de Ensino Superior situadas na cidade de Fortaleza. O foco da pesquisa foi o Núcleo de Prática Jurídica da UNICHRISTUS, o qual, com base em análises de documentos e em entrevistas, é descrito quanto ao seu funcionamento, estrutura e atividades. A pesquisa se aprofunda por meio da realização de grupos focais com os discentes do núcleo pesquisado, colhendo-se percepções sobre a atuação do núcleo em prol do acesso à justiça. Constata uma percepção maior da contribuição na formação do futuro profissional, o que indiretamente beneficia o acesso à justiça, e uma menor percepção sobre a relevância das atividades desempenhadas diretamente pelo núcleo para a comunidade vulnerável e carente de assistência jurídica. Abstract:
The scope of the work is to analyze the contribution of the activities of a Legal Practice Department in a Law School regarding the public policy aiming at the right of access to justice. Based on a bibliographic research, the access to justice is analyzed regarding its meaning, its historical context and its existence bound to the constitutional procedure model, so as to justify its definition as a fundamental right to be protected by means of public policies. The promotion of Brazilian public policies dedicated to the access to justice is evidenced through the analysis of the legal framework that is aimed at its development perspectives, the explanation of the judiciary reform and its motives, and through the approach of the promotion of jurisdictional policies. Focusing on the perspective of the legal assistance as a fundamental right of providing judiciary and legal assistance to the vulnerable, this work addresses the Public Defenders´ Office and the Legal Practice Departments convened to it and approaches the respective rules, implementation, motives and context. This work also describes the way the legal practice departments of the law faculties in the city of Fortaleza convened to the Public Defenders´ Office present themselves in their respective sites. The focus of the research was the legal practice department of UNICHRISTUS, which based on documents and interviews is described in what regards its functioning, structure and activities. The research is deepened by means of the organization of focused groups formed by the students of the legal practice department within which the perception regarding the role of the department on the access to justice is observed. It also concludes that the students´ perception of the relevance of the legal practice department relates more to its contribution to the formation of the future professional and less to the importance of the activities carried out directly by the department in favor of the vulnerable community which lacks on legal assistance.
