FÓRUM DCA CEARÁ E O GRUPO DE MÃES E FAMILIARES DO SOCIOEDUCATIVO: BUSCA PELA GARANTIA DOS DIREITOS DOS ADOLESCENTES E JOVENS EM CUMPRIMENTO DE MEDIDA DE INTERNAÇÃO

Este trabalho busca estudar as motivações e as reivindicações do Fórum Permanente das Organizações Não Governamentais de Defesa dos Direitos de Crianças e Adolescentes do Ceará e do Grupo de Mães e Familiares do Socioeducativo na busca pela garantia dos direitos dos adolescentes em cumprimento de medida de internação no Ceará. Para tanto, objetiva-se verificar o processo de luta dos movimentos sociais supracitados, que realizaram ações de participação e controle social frente ao Estado com reivindicações para o cumprimento do Estatuto da Criança e do Adolescente e do Sistema Nacional de Atendimento Socioeducativo, diante do contexto de crise do Sistema Socioeducativo do Estado do Ceará no ínterim de 2013 a 2017, marcado por intensos episódios de violência institucional e violação de direitos. Os objetivos traçados para a obtenção dos resultados da pesquisa foram: identificar as práticas punitivistas contra os adolescentes e os jovens no Sistema Socioeducativo; verificar a violação de direitos e violência institucional no sistema socioeducativo do Ceará com foco na medida de internação; verificar o processo de luta do Fórum DCA Ceará e do Grupo de Mães do Socioeducativo e identificar as conquistas dos movimentos sociais supracitados, na defesa dos direitos dos adolescentes em cumprimento de medida de internação no Ceará. Foi realizada uma pesquisa qualitativa. Como metodologia, foi utilizado o método em Marx, materialismo histórico-dialético; o estudo está norteado por pesquisas exploratória, bibliográfica e documental. As técnicas utilizadas desdobram-se em entrevistas e análise documental. Foram realizadas oito entrevistas semiestruturadas com quatro integrantes do Fórum DCA e quatro integrantes do Grupo de Mães e Familiares do Socioeducativo. No decorrer do trabalho, foi apresentado a historicidade do tratamento designado à adolescentes e jovens, caracterizada pela negação de direitos, punição e encarceramento, perpassando a trajetória desses sujeitos entre o paradigma da Doutrina da Situação Irregular e da Doutrina da Proteção Integral, situando o marco das legislações pertinentes às crianças e adolescentes, com enfoque no ECA e no SINASE. É nesse viés de luta de classe e disputa de estado que o Fórum DCA e o Grupo de Mães e Familiares do Socioeducativo incidem, reivindicando e articulando para obter a efetivação das Leis, e a garantia dos direitos fundamentais de adolescentes e jovens. Abstract:
This work search to study the motivations and claims of the Permanente Forum of Non-Governmental Organizations for the Defense of the Rights Children and Adolescents of Ceará and of the Group of Mothers and Families of the Socioeducational in the search for the guarantee of the rights of adolescents in compliance of hospitalization measure in the Ceará. Therefore, the objective is to verify the struggle process of the aforementioned social movements, which carried out actions of participation and social control against the State with demands for compliance with the Statute of the Child and Adolescent and the National System of Socio-Educational Assistance, against the context of crisis of the Socio-educational System of the State of Ceará between 2013 to 2017, marked by intense episodes of institutional violence and violation of rights. The objectives pursued to obtain the results of the research were: to identify the punitive practices against adolescents and young people in the Socio-educational System; to verify the violation of rights and institutional violence in the socio-educational system of Ceará, focusing on the hospitalization measure; to verify the struggle process of the DCA Ceará Forum and the Group of Mothers of the Socioeducational and to identify the achievements of the aforementioned social movements in the defense of the rights of adolescents in compliance with the measure hospitalization measure in Ceará. A qualitative research was realized. As a methodology, was used the method in Marx, historical-dialectical materialism; the study is guided by exploratory, bibliographical and documentary research. The techniques used unfold in interviews and documentary analysis. Eight semi-structured interviews were conducted with four members of the DCA Forum and four members of the Group of Mothers and Relatives of the Socioeducational. In the course of the work, the historicity of the treatment assigned to adolescents and young people was presented, characterized by denial of rights, punishment and imprisonment, crossing the trajectory of these subjects between the paradigm of the Doctrine of Irregular Situation and the Doctrine of Integral Protection, situating the children and adolescents with a focus on ECA and SINASE. It is in this bias of class struggle and state dispute that the DCA Forum and the Group of Mothers and Families of the Socioeducation focus, claiming and articulating to obtain the effectiveness of the Laws, and the guarantee of the fundamental rights of adolescents and young people.
