MEDIAÇÃO JUDICIAL E COMUNITÁRIA NO SISTEMA DE JUSTIÇA DO CEARÁ

Resumo:
A busca de uma resolução célere, amigável e justa se tornou um tema recorrente no Judiciário brasileiro. Há muito as pessoas buscam reafirmar seus direitos, ao resolverem seus conflitos, porém, nem sempre isto sendo possível de forma rápida e satisfatória como anseiam. O estudo realizado foi voltado ao conhecimento referente à análise da implementação da Mediação Judicial e Comunitária como Política Pública no Sistema de Justiça no Ceará, no contexto referente ao entendimento do acesso à justiça em instituições pioneiras da mediação no Ceará como o Centro Judiciário de Solução de Conflitos e Cidadania (CEJUSC) e o Núcleo de Mediação Comunitária do Pirambu (NMC-Pirambu). Por primeiro, cuidou-se de delimitar o objetivo geral da pesquisa, o qual foi compreender a prática da mediação judicial e comunitária como acesso à justiça, mediante experiências das instituições CEJUSC e o NMC- Pirambu, vigentes no Município de Fortaleza-CE, tendo como respaldo legal as Resoluções nº 125/2010 do Conselho Nacional de Justiça e a Resolução nº 118/2014 do Conselho Nacional do Ministério Público. Em termos de objetivos específicos da pesquisa, estabeleceu-se a abordagem sobre a mediação de conflitos como uma política pública de acesso à justiça e sua importância no Sistema de Justiça do Ceará; buscou-se o entendimento quanto aos conceitos, principais características e às legislações e atos normativos sobre a mediação judicial e comunitária como também a qualidade e formação do mediador e averiguou-se a realização das atividades e das demandas de acesso às mediações judiciais e comunitárias no CEJUSC e no NMC-Pirambu. Como metodologia da pesquisa, utilizou-se a análise documental e bibliográfica obtida através de buscas realizadas junto aos arquivos da coordenação do CEJUSC e do NMC-Pirambu como Relatórios Anuais e Estatísticos de 2016, Regimentos Internos e Resoluções dos Conselhos regentes das respectivas instituições. Quanto à pesquisa bibliográfica foram utilizados livros, periódicos, trabalhos acadêmicos como dissertações e teses relevantes às temáticas sobre mediação, acesso à justiça, políticas públicas, conflitos, diálogo, direitos humanos, direitos fundamentais e etc. Nesse contexto a pesquisa teve abordagem construída por meio de compreender o conceito de justiça e de direito, trazendo como relevância o vínculo existente entre o acesso à justiça e os direitos humanos, arraigados de princípios fundamentais para o ser humano e sua convivência social harmoniosa. Do conjunto da pesquisa, restou apresentado o bom acesso à justiça praticado pela mediação judicial e comunitária e o quanto esse meio consensual se tounou tema pertinente a ser solicitado pela sociedade para auxiliar na resolução de conflitos. Porém foram observados também, os desafios a serem enfrentados pelas instituições como o CEJUSC e o NMC-Pirambu referentes à qualidade da capacitação e formação de mediadores, quanto à valorização do seu papel reconhecido como profissão e o acompanhamento dos respectivos institutos estudados nessa pesquisa como também para os futuros setores e órgãos da justiça que possam vir a promover a mediação como pacificação de conflitos no Ceará, reflexões essas que poderão contribuir para o entendimento do objeto estudado, como também servirão de base para pesquisas futuras. Abstract:
The search for a quick, friendly and fair resolution has become a recurring theme in the Brazilian Judiciary. People have long sought to reaffirm their rights in resolving their conflicts, but this is not always possible as quickly and satisfactorily as they crave. The study was aimed at the knowledge regarding the analysis of the implementation of Judicial and Community Mediation as Public Policy in the Justice System in Ceará, in the context of the understanding of access to justice in pioneering institutions of mediation in Ceará as the Judicial Center for the Solution of Conflicts and Citizenship (CEJUSC) and the Pirambu Community Mediation Center (NMC-Pirambu). The first objective was to delimit the general objective of the research, which was to understand the practice of judicial and community mediation as access to justice, through experiences of the CEJUSC institutions and the NMC-Pirambu, in force in the Municipality of Fortaleza-CE. as legal support to Resolutions 125/2010 of the National Council of Justice and Resolution 118/2014 of the National Council of Public Prosecutions. In terms of specific research objectives, the approach on conflict mediation was established as a public policy of access to justice and its importance in the Justice System of Ceará; it was sought to understand the concepts, main characteristics and laws and normative acts on judicial and community mediation, as well as the quality and training of the mediator and investigated the accomplishment of activities and demands for access to judicial and community mediations in the CEJUSC and in the NMC-Pirambu. As a research methodology, the documentary and bibliographic analysis obtained through searches carried out with the archives of the coordination of CEJUSC and the NMC-Pirambu as Annual and Statistical Reports of 2016, Internal Regulations and Resolutions of the governing Councils of the respective institutions were used. As for bibliographical research, books, periodicals, academic works such as dissertations and theses relevant to the topics of mediation, access to justice, public policies, conflicts, dialogue, human rights, fundamental rights, etc. were used. In this context, the research had an approach built through understanding the concept of justice and law, bringing as a relevance the link between access to justice and human rights, rooted in fundamental principles for the human being and their harmonious social coexistence. From the research, the good access to justice practiced by judicial and community mediation has been presented, and how this consensual environment has become a pertinent topic to be asked by society to assist in the resolution of conflicts. However, the challenges faced by institutions such as CEJUSC and NMC-Pirambu regarding the qualification and training of mediators as regards the valorization of their recognized role as a profession and the monitoring of the respective institutes studied in this research were also observed. for the future sectors and organs of justice that may promote mediation as pacification of conflicts in Ceará, reflections that may contribute to the understanding of the object studied, but also serve as a basis for future research.
