A POLÍTICA PÚBLICA DE ACESSO À JUSTIÇA NOS JUIZADOS ESPECIAIS CÍVEIS DE FORTALEZA

Resumo:
Esta dissertação volta-se para a análise da aplicação de políticas públicas no âmbito dos juizados especiais cíveis de Fortaleza. Realizou-se por meio de pesquisa bibliográfica de autores clássicos e modernos referentes ao tema; pesquisa documental de resoluções e leis existentes no ordenamento jurídico brasileiro e cearense; bem como, pesquisa de campo com a aplicação dos questionários estruturados em questões fechadas, com jurisdicionados, advogados, conciliadores e juízes leigos que atuam nos juizados especiais em Fortaleza, no estado do Ceará. O objetivo geral deste trabalho trata da aplicação de políticas públicas de acesso à justiça por meio dos juizados especiais cíveis, com enfoque no método consensual de solução de conflitos, chamado de conciliação, como sendo uma maneira de resguardar o acesso à justiça. Na discussão dos resultados obtidos, verificou-se em um dos questionários a ausência permanente de qualificação dos conciliadores e juízes leigos no tema conciliação, bem como a inexistência de formulários de avaliação desses auxiliares da justiça; sendo ainda constatado que poucos juizados especiais realizam sessões de conciliação pré-processuais. Quanto ao questionário destinado aos jurisdicionados e advogados, averiguamos acerca da necessidade de uma maior divulgação na resolução de conflitos de maneira prévia, como também o interesse demonstrado pelas partes na unificação dos juizados especiais cíveis dessa capital, sendo assim possível criar um setor específico de peticionamento inicial e realização de audiência de conciliação na busca da efetividade jurisdicional. Conclui-se que é imprescindível para a garantia do acesso à justiça, que haja investimentos específicos para o Sistema dos Juizados Especiais, precipuamente, por meio de uma formação permanente dos conciliadores e da implantação da unificação desses juízos, para propiciar à sociedade uma estrutura adequada de resolução de conflitos mediante a conciliação. Abstract:
This dissertation acts to analyze the application of public policies in the scope of the special civil courts in the city of Fortaleza. This work was carried out through a bibliographical research of classic and modern authors referring to the theme; documentary research of resolutions and laws existing in the Brazilian and the State of Ceará legal system; as well as field research with the application of questionnaires structured in closed questions, with jurisdictions, lawyers, conciliators and judges who work in these special courts in Fortaleza, in the state of Ceará. The objective of this work is the application of public policies of access to justice through the special civil courts, focusing on the consensual method of conflict resolution, called conciliation, within the scope of the special courts of the state capital, as a way of protecting access to justice. In the discussion of the results obtained, one of the questionnaires verified the permanent lack of qualification of the conciliators and lay judges in the conciliation theme, as well as the deficiency of evaluation forms for these auxiliaries; It is also noted that few special courts conduct pre-trial conciliation sessions. In the questionnaire for jurisdictionals and lawyers, we inquired about the need for greater disclosure in the resolution of conflicts in advance, as well as the interest shown by the opposing parties in the unification of the special civil courts of the state capital, thus creating a specific sector for petitioning and holding a conciliation hearing in the search for jurisdictional effectiveness. It is concluded that it is essential for the guarantee of access to justice, that there be specific investments for the System of Special Courts, primarily through permanent creation of the conciliators and the implementation of the unification of these judgments, to provide society with an adequate structure conflict resolution through conciliation.
