Resumo:
Por um olhar de todos nós, o nosso país, na última década, está passando por transformações socioeconômicas, políticas e jurídicas. O momento é de mudanças, de olhar diferenciado aos problemas que acometem o Brasil desde o seu descobrimento. Esta dissertação busca fazer uma leitura sobre a violência sexual intrafamiliar contra crianças e adolescentes, mediante a análise de processos judiciais em que crianças e adolescentes foram vítimas de abuso sexual, no ambiente familiar, tomando como referência os processos judiciais julgados dos anos de 2010 a 2015, na 12ª Vara Criminal de Fortaleza. Assim, este estudo teve como objetivo descortinar os dados contidos nos referidos processos, que não chegam ao conhecimento da sociedade, e, com suporte nesses dados, trazer um olhar diferente acerca desse problema social. Em termos metodológicos, adotou-se uma abordagem qualitativa, utilizando-se a análise de documentação como principal técnica para a realização do trabalho de campo. Simultaneamente, procurou-se analisar o tema com esteio em um referencial teórico que permitisse trabalhar os conceitos de violência sexual, violência intrafamiliar, criança, adolescente, políticas públicas, dentre outros. Para tanto, fez-se preciso utilizar não somente a consulta a fontes documentais, mas também identificar as políticas públicas que tratam desse tipo de violência e sua conexão com possíveis estratégias e ações com a sociedade civil, no sentido de contribuir para a legitimação de opções democráticas que direcionem para medidas preventivas que quebrem a invisibilidade do problema. Com efeito, foi possível compreender as (re) significações da violência sexual intrafamiliar contra crianças e adolescentes, como fenômeno social, por meio da visão de um dos poderes instituídos da República Brasileira, o Poder Judiciário. Como principais resultados da pesquisa, confirma-se que as crianças e as adolescentes mulheres são as que mais sofrem violência sexual intrafamiliar, assim como o padrasto e o pai são os principais autores desta violência, e o estupro é o crime mais cometido na categoria violência sexual. Abstract:
Through a generalized view our country in the last decade is going through political, socioeconomic and juridical transformation. The moment is of changes, of looking at a different way to the problems that affect brazil since its discovery. This dissertatioin aims to conduct a survey on intrafamily sexual violence against children and adolescents through an analysis of judicial processes in which they have been victmis of sexual abuse in the family environment, analysing the lawsuits judged from the year 2010 to 2015 in the 12th criminal court at Fortaleza. In this way, this study aimed to bring to the surface information that do not come to the knowledge of society and based on these information bring a different view on this social problem. At the same time, our intention was to approach this topic in a theoretical way, highlighting the opinion of renowned doctrinators.For this it was necessary not only to consult documentary sources but also to identify the public policies that dead with this kind of violence and if they are in connection with the aspirations of society, always seeking to identify democratic options that help to remove this problem of sexual violence against children and adolescents from anonymity. In this way the objective of this research is to understand this kind of violence as a social phenomenon, through the vision of one of the instituted powers of the brasilian republic: the judiciary. As main search results of the research, it is confirmed that children and adolescents suffer the most from intrafamily sexual violence, just as the stepfather and the father are the main perpetrators of this violence, and rape is the most commited crime in the category of sexual violence.
