Resumo:
A presente dissertação aborda a Outorga Onerosa do Direito de Construir e os benefícios na área de urbanização por meio de um estudo realizado no município de Maracanaú. O direito de propriedade passou por grandes mudanças em seu regime na história da humanidade. Dentro deste contexto, objetiva-se investigar a aplicação da Outorga Onerosa do Direito de Construir, ou seja, como vem sendo utilizado esse instrumento jurídico no município de Maracanaú. Os objetivos específicos do trabalho são mostrar como o princípio da função social da propriedade aliada ao fenômeno da urbanização fomentou a edição de normas reguladoras do espaço urbano e estudar a forma como a Constituição Federal de 1988 instituiu os princípios de política urbana, atribuindo ao poder público municipal a competência para executar a referida política, de conformidade com as diretrizes gerais fixadas em lei, com vistas ao pleno desenvolvimento das funções sociais da cidade e ao bem-estar de seus habitantes. A dissertação pretende ainda analisar como e se as diretrizes gerais foram fixadas pelo Estatuto da Cidade que, entre outros instrumentos, previu a outorga onerosa do direito de construir em Maracanaú. O trabalho justifica-se pela relevância de um estudo relacionado ao instituto jurídico dentro do setor de controle urbano de um dos municípios com maior Produto Interno Bruto. No que tange à metodologia utilizada para a elaboração da dissertação, busca-se numa revisão bibliográfica e documental, de caráter exploratório, descritivo e qualitativo do tema em questão, um estudo histórico-evolutivo acerca do direito a cidade no âmbito internacional e âmbito nacional; dentro do direito de propriedade e direito urbanístico; investigando assuntos na legislação pertinente da outorga onerosa. Finaliza-se a pesquisa com análise de um exemplo específico no município de Maracanaú. O estudo aponta as dificuldades de implementação a contento da política pública de cobrança do instituto jurídico. Palavras-chave: Estatuto da Cidade. Outorga Onerosa. Direito de Construir. Abstract:
The present dissertation deals with the Onerous Grant of the Right to Build and the benefits in the area of urbanization: a case study carried out in the municipality of Maracanaú. The right of property has undergone great changes in its regime in the history of mankind. In this context, the objective is to investigate the application of the Onerous Grant of the Right to Build and how it has been used in the municipality of Maracanaú. The specific objectives of this work are showing how the constitutional consecration of the principle of the social function of property allied to the phenomenon of urbanization fostered the edition of norms regulating the urban space and studying the way that the Federal Constitution of 1988 instituted the principles of urban policy, attributing to the municipal public power the competence to execute said policy, in accordance with the general directives established by law, with a view to the full development of the social functions of the city and to the well-being of its inhabitants. The dissertation intends to analyse how and if the general guidelines that were set by the City Statute which, among other instruments, provided for the onerous granting of the right to build in Maracanaú. The work justifies itself for the relevance of a study about this legal instrument inside the urban control section of one of the municipalities with the biggest PIB. With regard to the methodology used for the elaboration of the thesis, a bibliographical and documentary review of exploratory, descriptive and qualitative character of the subject in question, a historical-evolutionary study about the right to city in the international scope and national scope; within the right of property and urban law; investigating matters in the relevant legislation of the onerous grant. This work is concluded with the analysis of an example in the municipality of Maracanaú. The study points the difficulties of the implementation according to the charging politics of the juridical instrument. Keywords: City Statute. Onerous grant. Right to Build.
