O enfrentamento do fenômeno da corrupção é uma preocupação mundial, dado que se apresenta e se manifesta sem comprometimento ideológico ou da forma como se organizam os Estados. Das democracias mais sólidas aos Estados totalitários e/ou teocráticos, o fenômeno está presente. Como consequência, surgem indicativos de que seu enfrentamento deve, necessariamente, romper as barreiras físicas das nações, mormente em tempos de globalização, onde a circulação de capitais e serviços ocorre em velocidade e por meios tecnológicos antes impensáveis. Sem muito esforço, o crime organizado ou não, encontrou na administração pública e privada das nações, campo fértil, para, fazendo uso do sistema político corrupto e patrimonialista, “capturar” as instituições do Estado, comprometendo sobremaneira a democracia, a economia e as condições sociais da população. O fenômeno desafiou a utilização de mecanismos de investigação mais invasivos, a exemplo da colaboração premiada, todos potencialmente suficientes, de per si, para sucesso de investigações complexas a envolver a macrocriminalidade. Referidos mecanismos de investigação, pela natureza excepcional, devem ser utilizados com parcimônia e responsabilidade redobradas, sem qualquer viés autoritário e/ou ideológico que venha a comprometer garantias e direitos fundamentais da pessoa humana, investigada ou não. A Constituição Federal do Brasil traz no seu preâmbulo o desafio de se construir um Estado Democrático destinado a assegurar o exercício dos direitos sociais e individuais, posto que tem como fundamento a dignidade da pessoa humana, figurando como um de seus objetivos fundamentais a construção de uma sociedade livre, justa e solidária. É certo que a sociedade não pode tolerar ou conviver com a impunidade e a corrupção generalizadas, e, muitos menos, em nome de uma cruzada moralista ver relegado a plano secundário direitos fundamentais, individuais e coletivos, inseridos como cláusulas pétreas na Constituição da República, arduamente conquistados após anos de luta contra um regime de arbítrio.
Confronting the phenomenon of corruption is a worldwide concern, since it presents itself and manifests itself without any ideological commitment or the way in which states are organized. From the most solid democracies to totalitarian and / or theocratic states, the phenomenon is present. As a consequence, they appear indicative that their confrontation must necessarily break the physical barriers of nations, especially in times of globalization, where the circulation of capital and services occurs at a speed and by technological means previously unthinkable. Without much effort, organized or unorganized crime, it found in the public and private administration of the nations a fertile field to use the corrupt and patrimonialist political system to "capture" the institutions of the State, greatly compromising democracy, economy and social conditions of the population. The phenomenon challenged the use of more invasive investigative mechanisms, such as the award-winning collaboration, all potentially sufficient, per se, for the success of complex investigations involving macro-crime. Such mechanisms of investigation, by the exceptional nature, should be used with parsimony and redoubled responsibility, without any authoritarian and / or ideological bias that would compromise the fundamental rights and guarantees of the human being, investigated or not. In its preamble, the Federal Constitution of Brazil contains the challenge of constructing a democratic state designed to guarantee the exercise of social and individual rights, since it is based on the dignity of the human person, and one of its fundamental objectives is the construction of a free, fair and supportive society. It is true that society can not tolerate or coexist with widespread impunity and corruption, and much less, in the name of a moralist crusade, to see relegated to the secondary plane fundamental, individual and collective rights, inserted as stony clauses in the Constitution of the Republic, arduously won after years of struggle against a regime of arbitrariness.
