A DEFENSORIA PÚBLICA E A EFETIVAÇÃO DO ACESSO À JUSTIÇA POR INTERMÉDIO DAS TUTELAS COLETIVAS

Resumo:
Esta dissertação tem por objeto a Defensoria Pública e sua atuação nas tutelas coletivas para a efetivação do acesso à justiça, mormente após a Lei n. 11.448/2007 e Emenda Constitucional n. 80/2014. Na primeira parte lançou-se base filosófica para o assunto, fortalecendo-a a partir dos princípios de justiça de John Rawls. Na parte segunda foi feito um apanhado do que há de mais recente sobre o assunto, inclusive zonas cinzentas sobre as quais não há entendimento firmado. A terceira e última parte se dedicou a analisar a atuação coletiva da Defensoria Pública a partir de casos selecionados do II Relatório Nacional de Atuações Coletivas da Defensoria Pública, de 2015, de autoria da Associação Nacional dos Defensores Públicos, vistos a partir do Índice de Vulnerabilidade Social do Instituto de Pesquisa Econômica Aplicada, visando aferir a efetividade do trabalho daquela instituição em tutelas coletivas e se houve, nos casos, o almejado acesso à justiça. A metodologia utilizada na pesquisa foi a seleção, com esteio nos indicadores das três dimensões do Índice de Vulnerabilidade Social, de casos do II Relatório de Atuações Coletivas da Defensoria Pública de melhor e de pior IVS global das categorias moradia, criança e adolescente e consumidor daquele Relatório, para avaliar a atuação da Defensoria Pública por intermédio de tutelas coletivas. As principais conclusões a que chegamos foi a percepção da atuação contra majoritária da instituição, sua função de dar voz aos desvalidos e incluí-los democraticamente ao garantir-lhes sua participação e influência político-sociais.

Abstract:
This dissertation aims at the Public Defender's Office and its role in collective tutelage for the effective access to justice, especially after Law n. 11.448/2007 and Constitutional Amendment n. 80/2014. In the first part the philosophical basis for the subject was launched, strengthening it from the principles of justice of John Rawls. In the second part was made a summary of what is most recent on the subject, including gray areas on which there is no agreement signed. The third and final part was devoted to analyzing the collective action of the Public Defender's Office based on selected cases of the Second National Report of Public Defender Activities of 2015, authored by the National Association of Public Defenders, viewed from the Vulnerability Index Social Program of the Institute of Applied Economic Research, in order to assess the effectiveness of the work of that institution in collective tutelage and if there was, in the cases, the desired access to justice. The methodology used in the research was the selection, based on the indicators of the three dimensions of the Social Vulnerability Index, of the cases listed at the Second National Report of Public of Public Defender Activities, the better and worse overall IVS of the categories of habitation, children and teenagers and consumer, to evaluate the performance of the Public Defender's Office through collective tutelage. The main conclusions we reached were the perception of the counter majority action of the institution, its role of giving voice to the underprivileged and including them democratically by guaranteeing them their political and social participation and influence.
