DISTÂNCIA ENTRE O LEGAL E O REAL

A presente pesquisa teve como proposta analisar o Programa de Internação executado em centro socioeducativo no Estado do Ceará, cujos objetivos consistiram em identificar as dificuldades em operacionalizar o que dispõe o SINASE; conhecer o perfil dos jovens em cumprimento de medida socioeducativa de internação; Identificar os atos infracionais que motivaram a internação dos jovens e analisar o processo de execução socioeducativo da unidade. Antes de iniciar o estudo foi realizado o mapeamento acadêmico-científico em Portal e base de origem brasileira, o Catálogo de Teses & Dissertações da Capes no que concerne aos descritores pesquisados: adolescente/jovem autor de ato infracional, ato infracional, medida de internação e SINASE, visando investigar a execução da medida socioeducativa em meio fechado. Para a realização do estudo os processos metodológicos, de caráter qualitativo e descritivo, consistiram em três etapas: i. Análise dos roteiros de inspeções do CNMP a unidade de internação dos anos de 2016/2017; ii. Realização de entrevista semiestruturada com o dirigente do centro socioeducativo; e iii. Acesso às transcrições das falas de familiares de jovens internos em grupo focal realizado pelo Núcleo de Pesquisa Social da Universidade Estadual do Ceará. O resultado da pesquisa identificou que os jovens autores de ato infracional possuem idade entre 12 e 15 anos, se envolveram com práticas infracionais, majoritariamente, de natureza patrimonial, com destaque para roubos e latrocínios, com crimes contra a vida (homicídios), tráfico de entorpecentes e porte de arma de fogo. Demonstrou que estes jovens são marcados pelo estigma de seus territórios, dominados por organizações criminosas e, como forma de sobreviver no espaço institucional, se autodeclaram pertencentes ou simpatizantes de alguma organização criminosa. Ao final, restou evidenciado que a participação da família é essencial neste processo, concebendo-a a partir do paradigma socioafetivo, com abertura de espaços para sua contribuição através do Plano Individual de Atendimento, do Programa Abraço em Família e das visitas sociais. A participação dos jovens, sob a dinâmica de sujeito da ação socioeducativa começa a ser desenhada através das Assembleias, mas ainda é frágil. O esforço do Estado do Ceará em adequar o atendimento socioeducativo, sob os paradigmas do SINASE, é perceptível, com a implantação de rotina, metodologia de fases, escuta dos internos, valorização da arte e da cultura no projeto pedagógico, contudo, permanecem práticas disciplinar-punitivas que colocam o esforço da política socioeducativa, em reordenamento, em cheque, porque compromete as bases da ação socioeducativa na sua dimensão ética, pedagógica e organizacional, de modo que todo o investimento não é suficiente para que o discurso reflita no “chão da unidade”. Abstract:
The present research was aimed at analyzing the hospitalization program performed in a socioeducational center in the state of Ceará, whose objectives consisted of: to identify the difficulties in operationalizing what the sinase provides; To know the profile of young people in compliance with the socio-educational measure of hospitalization; Identify the infractions that motivated the hospitalization of young people and analyze the process of socio-educational implementation of the Unit. Before starting the study, we performed the academic-scientific mapping in Portal and base of Brazilian origin, the catalogue of theses and dissertations of Capes regarding the descriptors researched: adolescent/Young author of Infractional Act, Infractional Act, Measure of hospitalization and sinase, aiming to investigate the implementation of the socio-educational measure in closed environment. In order to carry out the study, the methodological processes, of a qualitative and descriptive nature, consisted of three stages: I. Analysis of the CNMP inspection scripts the hospitalization unit of the years 2016/2017; II. Conducting semi-structured interviews with the director of the Socio-educational center; and III. Access to transcripts of the speeches of family members of internal youths in a focal group conducted by the research nucleus of the State University of Ceará. The result of the research identified that the young authors of Infractional Act are aged between 12:15 years, were involved with infractional practices, mostly of patrimonial nature, with emphasis on robberies and latroproducts, with crimes against life (Homicides), narcotics trafficking and firearm possession. It has shown that these young people are marked by the stigma of their territories, dominated by criminal organizations and, as a way of surviving in the institutional space, self-declared belonging or sympathizers of some criminal organization. At the end, it was evidenced that the participation of the family is essential in this process, conceiving it from the socio-affective paradigm, with the opening of spaces for its contribution through the Individual care plan, the family Hug program and the Social visits. The participation of young people, under the dynamics of the subject of socio-educative action, begins to be drawn through the assemblies, but still fragile. The effort of the state of Ceará to adapt the socioeducational service under the paradigms of Sinase, is noticeable, with the implantation of routine, methodology of phases, listening of the interns, appreciation of art and culture in the pedagogical project, however, remain Disciplinary/punitive practices that put the effort of socio-educational policy, in reordering, in check, because it compromises the bases of socio-educative action in its ethical, pedagogical and organizational dimension, so that all investment is not Enough for the speech to reflect on the "floor of the unit".
