OS DIREITOS HUMANOS COMO EFETIVAÇÃO DA IDEIA DE LIBERDADE EM HEGEL

Resumo:
Esta pesquisa tem por finalidade demonstrar a hipótese de que, na exposição da própria Filosofia do Direito, há uma gênese especulativa dos direitos humanos modernos a partir do desenvolvimento da ideia de vontade livre em si e para si. Diante disso, a metodologia a ser utilizada se baseia na pesquisa qualitativa do tipo bibliográfica, pela qual trabalharemos a obra: Linhas Fundamentais da Filosofia do Direito ou Direito Natural e Ciência do Estado em Compêndio. Com efeito, o objetivo desse trabalho é abordar, primeiramente, as determinações hegelianas referentes ao “método” científico (a dialética especulativa), ao objeto (a ideia do direito) e a estrutura da Filosofia do Direito. Em seguida, trabalharemos ainda a gênese das categorias constitutivas dos direitos humanos a partir da efetivação do primeiro momento da vontade livre, isto é, na esfera imediata do direito abstrato ou formal. E por fim, trataremos de adentrar na esfera da substância ética, a saber, mais especificamente no âmbito da família e da sociedade civil burguesa, a fim de expor a efetivação dos direitos humanos nas instituições. Contudo, chega-se ao resultado que há uma gênese das categorias constitutivas dos direitos humanos já no próprio desenvolvimento da ideia de vontade livre, a saber, expresso no direito da propriedade privada, no direito de liberdade, no direito à igualdade perante as leis, no direito de dignidade da pessoa humana, no direito à vida, etc.

Abstract:
This research aims to demonstrate the hypothesis that the exposure of the Philosophy of Law itself, there is a speculative genesis of modern human rights from the development of the idea of free will, in itself and for itself. Therefore, the methodology to be used is based on the qualitative research of the bibliographical type, by which we will work the Fundamental Lines of Philosophy of Law or Natural Law and State Science in Compendium. Indeed, the aim of this study is to first address the Hegelian determinations relating to the scientific "method" (the speculative dialectic), the object (the idea of law) and the structure of the Philosophy of Law. Then, we will still work the genesis of the constituent categories of human rights from the realization of the first moment of free will, that is, in the immediate sphere of abstract or formal right. Finally, we will try to enter the sphere of ethical substance, namely, more specifically within the family and bourgeois civil society, in order to expose the realization of human rights in the institutions. However, we come to the result that there is already a genesis of the constituent categories of human rights in the very development of the idea of free will, i.e., expressed in the right to private property, the right to liberty, the right to equality before the laws, the right to human dignity, the right to life, etc.
