RESUMO
O presente trabalho investiga o conjunto das formas linguísticas e das estratégias de uso da linguagem que foram utilizadas para atribuir sentidos aos direitos humanos, nas práticas sociodiscursivas normativa e institucional de proteção, com foco sobre as dimensões política e iedológica dessa construção discursiva no mundo contemporâneo. Para tanto, toma-se, como referencial teórico principal, a Análise de Discurso Crítica de Norman Fairclough ([1992] 2001; 2003), além de um diálogo com o pensamento de teóricos sociais críticos como Ernesto Laclau. Diante do aporte teórico da ADC e sua visão do discurso inserido em (redes de) práticas sociais, o trabalho situa-se no horizonte metodológico da pesquisa qualitativa, adotando como estratégia para geração de dados o estudo documental. Emprega-se, ainda, um diálogo interdisciplinar com o Direito Internacional dos Direitos Humanos. O corpus selecionado para a pesquisa inclui os diplomas normativos que fixam direitos humanos - notadamente a Carta Internacional de Direitos Humanos – assim como documentos que consubstanciam a luta para efetivação desses direitos, vislumbrados na atuação concreta da Comissão de Direitos Humanos da Câmara Municipal de Fortaleza/CE. Entre as principais reflexões desenvolvidas, consideramos que os direitos humanos, nos domínios discursivos apontados, são representados como uma universalidade que deriva de uma particularidade. Observamos que é no seio das lutas por direitos que se formam as articulações identitárias geradoras de novos sentidos para direitos humanos. Para o contexto das lutas, é muito pertinente esse ponto de vista acerca do potencial do discurso para intervir sobre as práticas, o que pode representar uma atitude estratégica.
This study investigates the whole of linguistic forms and language use strategies which have been used to attribute meaning to human rights on two kinds of sociodiscursive practices – normative practice and practice of institutional protection of human rights – focusing on policy and ideological dimensions of this discursive construction in the contemporary world. Therefore, we take Critical Discourse Analysis from Norman Fairclough ([1992] 2001; 2003) as the main theoretical framework, besides a dialogue with the critical thinking of social theorists such as Ernesto Laclau. According to the theoretical support of the CDA and its vision of discourse as inserted into (networks of) social practices, this work is situated in the methodological horizon of qualitative research, adopting the documental study as the strategy to generate data. It is used also an interdisciplinary dialogue with the International Human Rights Law. The research corpus includes regulatory instruments that secure human rights – notably the International Bill of Human Rights – as well as documents that embody the struggle to realize these rights, glimpsed in the concrete actions of Defense of Human Rights Commission of the City Council in Fortaleza / CE. Among the main reflections developed, we assert that human rights, in the mentioned discursive fields, are represented as a universality that derives from a particularity. We note that it is within the struggles for rights that form the identity generating joints of new meanings for human rights. For the context of the struggles, it is very relevant this view about the discourse's potential to intervene in the practices, which may represent a strategic attitude.
