RESUMO
O presente estudo “Faces e Disfarces da Medida Socioeducativa de Internação de Fortaleza”, teve como objetivo principal desvendar o processo do controle sociopenal dos adolescentes no Sistema de Justiça Juvenil através da Medida Socioeducativa de Internação de Fortaleza/Ce. Nesse sentido, a pesquisa buscou analisar a intercessão do sistema de justiça juvenil e as práticas do campo socioeducativo de internação de Fortaleza. Adotou-se por principais referências normativas o Estatuto da Criança e Adolescente (ECA) e o Sistema Nacional de Atendimento Socioeducativo (SINASE). Tomou-se como campo de investigação a 5ª Vara da Infância de Juventude de Fortaleza/CE, unidade judiciária responsável pela execução das medidas socioeducativas, onde se foi possível realizar entrevistas semiestruturadas com 20 adolescentes em cumprimento de medida de internação e analisar seus respectivos processos de execução, com o suporte do diário do campo, a fim de apreender os interlocutores da pesquisa em sua relação com a justiça. A partir da base teórica faz-se um apanhado histórico sobre o surgimento da pena privativa de liberdade na Europa no contexto da sociedade capitalista, o que possibilitou uma compreensão crítica da prisão na contemporaneidade, quando se tem a expansão do cárcere como expressão do Estado “penal”, relacionando-o com o recuo das políticas sociais no Estado capitalista neoliberal brasileiro e suas repercussões no atendimento voltado à criança e ao adolescente, em especial os adolescentes autores de atos infracionais. A partir do pressuposto de que a medida socioeducativa de internação faz parte do aparato repressivo estatal dispensado ao adolescente, a relevância da pesquisa consiste em analisar a sua execução do ponto de vista do controle sociopenal. Os resultados evidenciam que a forma de operar o controle sociopenal sobre o adolescente em Fortaleza reafirma as práticas punitivas e antigarantistas aos direitos fundamentais dos adolescentes e que seus os mecanismos possibilitam um ciclo perverso da criminalização dos adolescentes.

Abstract:
ABSTRACT
The present of this study, "Faces and Disguise of the inimputabilly Socioeducative measures of Fortaleza freedom deprivation", is aimed at the process of sociopenal control of adolescents in the Juvenile Justice System through the inimputabilly Socioeducative measures of freedom privation of Fortaleza / CE. In this sense, the research sought to analyze the intercession of the juvenile justice system and the practices of the socioeducative measures of freedom deprivation in Fortaleza. The main normative references were the Child and Adolescent Statute and the National Socio-Educational Service System The Fifth Childhood Court of Fortaleza / CE, a judicial unit responsible for carrying out socio-educational measures, took place to the investigation, where it was possible to conduct semi-structured interviews with 20 adolescents in compliance with the freedom deprivation inimputabilly socioeducative measures and to analyze their respective execution, with the support of one diary, in order to apprehend the research interlocutors in their relationship with justice. From the theoretical basis, a historical survey is made of the emergence of the prison in Europe in the context of capitalist society, which made possible a critical understanding of the prison in contemporary times, when one has the expansion of the jail as an expression of the State " criminal, "relating it to the retreat of social policies in the Brazilian neoliberal capitalist state and its repercussions on the care directed at the child and the adolescent, especially the adolescents authors of infractions. Based on the assumption that the inimputabilly socioeducative measures of freedom deprivation is part of the state repressive apparatus dispensed to the adolescent, the relevance of the research is to analyze its execution from the point of view of sociopenal control. The results show that the way of operating socio-political control over the adolescent in Fortaleza reaffirms the punitive and against law practices to the fundamental rights of adolescents and that their mechanisms allow a perverse cycle of the criminalization of adolescents.
