AS RELAÇÕES TRABALHISTAS E A CLT EM TEMPOS DE DITADURA MILITAR: FORTALEZA (1968-1970)

RESUMO Este trabalho analisa as ações dos trabalhadores urbanos de Fortaleza durante o período do famoso “Milagre Econômico”, momento no qual foram realizadas várias modificações tanto na Legislação Trabalhista quanto na Justiça do Trabalho para atender as necessidades do capital externo, visando ao investimento no setor industrial brasileiro, para assim retirar o país da estagnação econômica em que se encontrava e colocá-lo entre as grandes potências mundiais. Dentro desta conjuntura, os operários tiveram seus direitos trabalhistas modificados para acatar as exigências de investimento externo, que no período eram: um movimento operário controlado e a tão sonhada paz social. Assim, foram feitas alterações na CLT que não auxiliavam o trabalhador na defesa de seus direitos, mas ao empresariado local a explorar a força de trabalho do operário em prol do lucro e do enriquecimento. Os trabalhadores então passaram a utilizar a única ferramenta que o regime não lhes havia retirado: a Justiça do Trabalho. Embora esta tenha sofrido transformações para se ajustar ao plano econômico dos militares, eles conseguiram ressignificar a forma como este órgão jurídico era visto pelo próprio operariado demonstrando ao regime que não estavam de acordo com a forma como eram tratados nem estavam assumindo o papel de seus aliados na construção da imagem de um país forte e próspero às custas da exploração e desqualificação do trabalhador. Abstract:
ABSTRACT This paper analyzes the actions of urban workers in Fortaleza during the famous period Economic Miracle, at which time there have been several changes in both the Labour Law and in labor courts to meet the needs of foreign capital, targeting investment in the Brazilian industrial sector to so remove the country from economic stagnation in which it was and put it between the major powers. Within this context, the workers had their labor rights modified to accept the foreign investment requirements in the period were: a controlled labor movement and the long awaited social peace. So changes were made in the CLT not assisted the workers in defense of their rights, but the local business community to explore the worker's labor force for profit and enrichment thereof. Workers then start using the only tool that the regime did not withdraw them, the Labour Court. Although it has undergone transformations to fit the economic plan of the military, they were able to reframe the way this legal body was seen by the very working class demonstrating the regime that did not agree with the way they were treated or were assuming the role of its allies in building the image of a strong and prosperous country at the expense of exploration and disqualification of the worker.
