Objetiva-se, com esta dissertação, demonstrar como o sistema do direito representa o sistema da liberdade. Seguindo metodologicamente os Princípios da Filosofia do Direito de Hegel, articulamos o direito como momento de concretização e efetivação da liberdade da vontade. Para tanto, inicia-se apresentando as relações da vontade imediata no Direito Abstrato, seguindo pelas determinações morais da vontade subjetiva na Moralidade e por fim a compreensão da vontade ética na Eticidade. Na Eticidade, a vontade efetiva a sua liberdade por meio das instituições, pois elas viabilizam a concretude da vida ética. A exposição de cada instituição nas minúcias de seu desenvolvimento, a Família, a Sociedade Civil e o Estado, será abordada segundo sua importância como instituição necessária para a efetivação da liberdade. No entanto, chega-se à compreensão de que somente no Estado a vontade concretiza verdadeiramente a sua liberdade. O Estado ético concilia o reino das necessidades com o reino da liberdade, ou seja, concilia a liberdade individual e coletiva. Sendo assim, a conciliação passa a ser tida como a determinação plena da efetivação da liberdade e da vontade. Palavras- chave: vontade, direito, liberdade.
Abstract:
The objective of this dissertation is to demonstrate how the system of right represents the system of freedom. Methodologically based on the work Elements of the Philosophy of Right by Hegel, we articulated the right as the moment of achievement and fulfillment of the freedom of will. It starts presenting the relations of the immediate will in the abstract right, followed by the moral bearings of the subjective will in morality, and at last by the understanding of the ethical will in ethics. In ethics, the will fulfills its freedom by institutions, since they enable the achievement of the ethical life. The presentation of each institution and every detail of its development, the Family, the Civic Society and the State, will be dealt with according to its importance as a vital institution to the fulfillment of freedom. However, it comes to the understanding that only in the state the will truly fulfills its freedom. The state as ethical reconciles the needs and the freedom, that is, it reconciles individual and public freedom. Thus this reconciliation is taken as the full determination of the fulfillment of the freedom and of the will. Key words: will, right, freedom.
