Crítica da violência e do poder em Walter Benjamin

Resumo:
A discussão sobre a governabilidade da Alemanha de entre guerras, e a observação
de sua crescente instabilidade, já sinalizando uma nova barbárie, leva a reflexão de
Walter Benjamin sobre aquele espaço político a deduzir a vulnerabilidade da
Constituição da República de Weimar, que acabou ferida com o estado de exceção
nazista. O ensaio Crítica da Violência Crítica do Poder, (Zur Kritik der Gewalt) que
visa à crítica ao ordenamento jurídico de uma organização estatal, confirma nesse
sistema a sua derivação do poder mítico quando o “ato legal” não consegue mais
dizer a justiça. Assim Benjamin analisa as discrepâncias do direito natural e do
direito positivo, utilizando-se para isso da filosofia de sua história. Na investigação
do absolutismo seiscentista enfocado pela estética barroca aparece um fragmento
significativo que serve de fundamento para a reconceituação da teoria da soberania.
Na ótica da dramaturgia barroca (Trauerspiel) a arte de governar rompe com a
prescrição do Direito Constitucional, desafiando, dessa forma, o sistema jurídico do
principado barroco, para inaugurar o exercício de outra ação política que leve em
consideração as leis da alteridade. Essas leis são cumpridas, através da mobilização
de afetos na alma. Apoiadas em uma ética pseudo-estóica, elas conseguem
recuperar o equilíbrio político e a estabilização da história, uma vez que esse
estoicismo se acha pincelado, no barroco, de laivos do cristianismo, que constroem
a motivação de uma identidade entre súdito e príncipe.

Abstract:
The discussion on the management of inter-war Germany, and the observing of its
growing instability, already indicating a new barbarism, takes Walter Benjamin's
reflection on the political space to deduce the vulnerability of the Constitution of the
Weimar Republic, which ended wound by the Nazi state of exception. The essay
"Critique of Violence Critique of Power, (Zur Kritik der Gewalt) which seeks to critique
the legal system of a state organization, confirms in that system its derivation from
the mythical power as “the legal act" can no longer promote justice. So Benjamin
analyzes the discrepancies of natural law and positive law, using the philosophy of its
history. In the investigation focused on the seventeenth-century absolutism baroque
aesthetic, a significant fragment appears which forms the basis for the
reconceptualization of the theory of sovereignty.Through the view of Drama baroque
(Trauerspiel), the art of government breaks with the Constitutional requirement of
law, challenging, thus, the legal system of princely baroque, to inaugurate the
exercise of other political action that takes into account the laws of otherness. These
laws are enforced, through the mobilization of affections in the soul. Backed by a
pseudo-Stoic ethics, they can recover their balance and stabilization of political
history, since that stoicism is brushed, in the Baroque, with the traces of Christianity,
the motivation for building an identity between subject and ruler.
