A MOROSIDADE DO JUDICIÁRIO COMO DESAFIO: O CASO DO TRIBUNAL DE JUSTIÇA DO ESTADO DO CEARÁ.

Esta pesquisa foi desenvolvida com o objetivo de analisar os impasses enfrentados pelo Poder Judiciário, particularizando o caso para Tribunal de Justiça do Estado do Ceará, para a implementação e execução de políticas de promoção da duração razoável do processo. O universo estudado tem como pano de fundo a análise, a partir de dados fornecidos pelo Conselho Nacional de Justiça, da produtividade das varas cíveis da Comarca de Sobral no triênio 2012-2014, analisando-se nesse período o número de processos distribuídos e arquivados definitivamente, a fim de que pudéssemos verificar se havia reais sinais de intempestividade dos processos, ou se isso se tratava tão-somente de um sentimento afeto ao senso comum. Compreender a aplicabilidade do direito à duração razoável do processo se faz de assaz relevância e importância, haja vista que a eficácia dos direitos fundamentais é matéria basilar ao Estado Democrático de Direito e se correlaciona estreitamente com o ideal de Justiça. Esta, para os fins deste trabalho, é entendida como um como um consenso político original (John Rawls) que deve constantemente ser buscado, ainda que a lei eventualmente aponte em sentido contrário. O Poder Judiciário, bem como todos os outros Poderes, nessa missão de distribuir a justiça tem fundamental importância, não somente como órgão meramente jurisdicional, mas como protagonista de políticas públicas, por exemplo, de promoção da tempestividade processual, daí a relevância de compreendermos as dificuldades na adoção de ações prestacionais por parte do Estado através de políticas públicas para a promoção desses direitos. Todavia essa postura do Poder Judiciário ainda não se tem verificado de forma expressiva, não conseguindo ainda o Poder Judicário se compreender como órgão político. Isso tem se dado por força de uma herança histórico-político-estrutural que ainda se encontra impregnada em suas entranhas e que tem se revelado como verdadeiro impasse ao enfrentamento das causas da intempestividade do processo. Abstract:
This research was developed with the objective of analyzing the impasses faced by the Judiciary, particularizing the case to the Court of Justice of the State of Ceará, for the implementation and execution of policies to promote the reasonable duration of the process. Based on data provided by the National Council of Justice, the universe studied has the analysis of the productivity of civil courts in the Sobral region in the 2012-2014 triennium, analyzing in this period the number of cases filed and definitively filed , so that we could verify whether there were real signs of untimely processes, or whether this was merely a feeling of common sense. Understanding the applicability of the right to a reasonable length of process is of considerable relevance and importance, since the effectiveness of fundamental rights is a basic matter for the Democratic State of Law and correlates closely with the ideal of Justice. This, for the purposes of this work, is understood as one as an original political consensus (John Rawls) which must constantly be sought, even if the law eventually points in the opposite direction. The Judiciary, as well as all other Powers, in this mission of distributing justice has fundamental importance, not only as a merely judicial body, but as the protagonist of public policies, for example, to promote procedural timeliness, hence the importance of understanding the difficulties in the adoption of actions by the State through public policies to promote these rights. However, this position of the Judiciary has not yet been verified expressively, and the judiciary can not yet understand itself as a political body. This has been done by virtue of a historical-political-structural heritage that is still impregnated in their own gut, and which has proved to be a real impasse in confronting the causes of the process's inopportuneness.
